Soumitra Kumar Nahar vs Parul Nahar

Bench: 2 — Ajay Rastogi

In Brief

This appeal concerns custody of two minor children whose parents separated following a breakdown of marriage. The father sought custody while the mother opposed his claims. The Supreme Court held that the best interest of the child is the paramount consideration in custody disputes, overriding technical objections. The Court directed that the interim arrangement for visitation rights previously established shall continue, permitting both parents to file independent custody or guardianship petitions to be decided independently by competent courts without being influenced by these proceedings. A trilateral consent order cannot be unilaterally withdrawn by one party.
