South Eastern Coalfields Ltd appealed a High Court order that directed deposit of Rs. 91 lacs (obtained via bank guarantee) with the Registrar pending final disposal of an underlying suit. The Supreme Court granted leave and took up the appeal. After hearing both sides, the Court found that continuing the interim stay order granted at admission of the SLP was in the interests of both parties. The Court accordingly continued the stay of the High Court's judgment pending final disposal of the suit, disposing of the appeal on this basis.
