Sports & Leisure Apparel Ltd vs Commissioner of Central Excise, Noida

Bench: 2 — A.K. Sikri

In Brief

This case concerns the entitlement of knitted garment manufacturers to claim exemption from excise duty under Notification Nos. 14/2002-CE and 15/2002-CE. The central issue was whether manufacturers could claim exemption when input fabrics lacked documentary proof of duty payment. The Supreme Court held that Explanation II to these notifications created a legal fiction deeming textile fabrics duty-paid even without documents. Interpreting this fiction in light of the government's budgetary intent, the Court ruled that manufacturers not availing CENVAT credit were entitled to the exemption without insisting on proof of actual duty payment. Assessees' appeals were allowed and Revenue appeals dismissed.
