The Labour Commissioner awarded him compensation based on 50% disability, which the High Court increased to 60%. The Supreme Court enhanced the compensation further, assessing his functional disability at 100% loss of earning capacity, since the driver could no longer perform his vocation and would be disqualified from obtaining a driving license. The Court awarded Rs. 4,83,984/- compensation plus Rs. 1,00,000/- for medical expenses with 6% annual interest from the accident date.
