Chanappa Nagappa Muchalagoda vs Divisional Manager, New India Insurance Company Limited

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A worker suffered injuries in an employment accident and claimed enhanced compensation under the Workmen's Compensation Act, 1923. The High Court had assessed his functional disability at 100% and computed compensation based on his assessed income, but awarded no amount for hospitalization and medical expenses despite his 65-day hospitalization and surgical treatment. The Supreme Court allowed the appeal, enhancing the compensation payable under Section 4 of the Act and awarding an additional lump sum for medical and hospitalization expenses. Interest at 6% per annum was also directed from one month after the accident date until payment.
