Sridhar & Anr vs N. Revanna & Ors

Bench: 2 — UNKNOWN, UNKNOWN

In Brief

Sridhar and another appellant challenged a High Court judgment concerning a gift deed with conditions regarding property devolution. The appellants sought to avoid a sale of the gifted property, claiming a condition in the original gift deed prohibited sale. The Supreme Court held that a stipulation in the gift deed allowing male children born later to become joint holders was valid under the Transfer of Property Act, 1882. The recipient of the gift became entitled to transfer the property. The Court found the High Court erred in limiting relief, but dismissed the appeal as the plaintiffs had no legal basis to seek declaration against the sale."
