Landowners entered a Joint Development Agreement with a developer to construct and sell flats. The developer delayed handing over possession by over six years beyond the promised 36-month period. Flat buyers filed a complaint claiming deficiency in service. The National Consumer Disputes Redressal Commission ordered the developer to complete construction and pay delay compensation, but did not hold landowners liable. When buyers sought to make landowners jointly liable, the Supreme Court upheld the original decision. The Court found that the developer alone held construction obligations and had indemnified the landowners against construction-related losses. Landowners were directed only to transfer title, not to pay delay compensation. The appeals were dismissed.
