A property auction purchaser challenged the non-grant of interim relief by the Debt Recovery Appellate Tribunal (DRAT) while his main appeal on merits was still pending. The High Court of Delhi granted an opportunity to deposit the balance amount with damages and directed the property be delivered to him. The Supreme Court held this order exceeded the High Court's jurisdiction. The Court found that the High Court had improperly decided the substantive merits when it should have confined itself to the limited issue of interim relief. The judgment was quashed, allowing the DRAT to proceed with deciding the main appeal on its merits independently."
