Standard Chartered Bank sought review of orders of a Debt Recovery Tribunal (DRT) dismissing its application for condonation of delay in filing a review petition. The High Court allowed a writ petition, holding that review dismissals were not appealable and a writ petition was therefore maintainable. The Supreme Court held that review petitions are independent proceedings under Rule 5A, not 'applications' under Section 24 of the RDB Act, and the Limitation Act's condonation provisions do not apply to them. The Court held that appeals against review dismissal orders are maintainable to the Appellate Tribunal under Section 20, making writ petitions an inappropriate remedy. The RDB Act is a complete code superseding the Code of Civil Procedure. The appeal was allowed and the High Court's judgment set aside."
