SBI challenged an NCLAT order disqualifying its former employee as Resolution Professional in a corporate insolvency case merely because he remained in SBI's service and received pension. The Supreme Court held that such continued employment and pension receipt do not automatically disqualify a Resolution Professional. The Court rejected NCLAT's approach, clarified that replacing a Resolution Professional does not impugn his integrity, and directed the NCLT to appoint a new one in accordance with insolvency law.
