State Bank of India challenged the High Court's decision that set aside the removal order of a bank officer (Mohammad Badruddin) for violating natural justice principles. The Supreme Court held that while the 42nd Constitutional Amendment removed the requirement for a second show-cause notice on proposed punishment, the Disciplinary Authority must still furnish the Inquiry Report to the delinquent and communicate reasons for disagreeing with the Inquiry Officer's findings before recording final findings on guilt. Since the delinquent had attained superannuation, the Court remitted the matter to the Disciplinary Authority to determine appropriate relief on back wages and terminal benefits rather than granting full consequential benefits.
