In Brief

The Supreme Court set aside a disciplinary punishment order against a State Bank of India employee on the ground that the Inquiry Report was not supplied to him before punishment was imposed, violating natural justice principles guaranteed under Article 311 of the Constitution. Since the employee had reached superannuation age, reinstatement or suspension were not possible remedies. The Court remanded the matter to the Disciplinary Authority to reconsider punishment based only on charges in dispute and to determine back wages and terminal benefits within three months, upholding the procedural fairness requirements in employment disciplinary proceedings."
