State of Bihar & Ors vs Smart India Marketing & Anr

Bench: 2 — Kurian

In Brief

The State of Bihar challenged a High Court interim order that had directed the de-sealing of a godown and release of seized goods on a Rs. 40 lakh surety bond in a writ petition involving alleged violations of the Bihar Prohibition and Excise Act, 2016. The Supreme Court allowed the appeal by deferring implementation of the High Court's interim order pending final disposition of the writ petition. The Court permitted the respondents to amend pleadings within two weeks and requested the High Court to expeditiously decide the main writ petition within six weeks.
