State of Gujarat vs Dhirendrasingh @ Jabarsingh Chauhan

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

In this criminal appeal, the Supreme Court reviewed the High Court's decision to grant bail to Dhirendrasinh, the driver of one of the alleged conspirators in a murder case. The victim was killed with nine deep knife wounds (some up to 14 cm), allegedly as part of a conspiracy involving the victim's wife and her paramour. The Court found that the High Court had failed to adequately appreciate the gravity of the offence and the prima facie evidence of the accused's presence at the crime scene. Consequently, the Court set aside the bail order and directed the state to take the accused into immediate custody, emphasizing that such brutal murders committed as part of a conspiracy warrant detention during trial proceedings.
