Daily wage workers employed by Gujarat's Forest Department who attained permanent status through years of service challenged the State's implementation of a prior Supreme Court judgment. The Court held that permanent daily wagers are entitled to benefits under the original 1988 scheme but cannot claim pay scales exceeding those of regularly appointed employees. Workers regularized before April 1, 2005 retain General Provident Fund (GPF) benefits; later regularizations fall under the Contributory Pension Fund scheme. Casual leave must equal, not exceed, regular employees' entitlements. The State was directed to recalculate and pay benefits within two months.
