State of Haryana and Another vs Ved Kaur

Bench: 2 — Uday Umesh Lalit

In Brief

A Haryana teacher, Dharam Singh, was convicted under Section 304 IPC and dismissed from service without inquiry on grounds of moral turpitude. His co-accused with similar role were later acquitted of the same charge but convicted only under Section 323 IPC. The widow claimed reinstatement benefits. The Supreme Court held that Section 323 does not involve moral turpitude under State policy instructions. Dismissal was set aside, and the widow became entitled to all consequential benefits except back wages, which accrue only from the date of demand for reinstatement, not from the date of wrongful dismissal.
