State of Haryana and Another vs Ved Kaur

Bench: 2 — Uday Umesh Lalit

In Brief

A deceased JBT teacher employed since 1967 by Haryana was convicted under Section 304 IPC and dismissed without inquiry. When his co-accused were acquitted of the same charge but convicted under Section 323 IPC, the widow sought reversal of the dismissal and service benefits. The Supreme Court held that Section 323 IPC does not constitute moral turpitude under Haryana policy, and the acquittal of the co-accused undermined the conviction's reliance. The Court granted the widow all consequential benefits except back wages, as the deceased had expired before any reinstatement could occur.
