Supreme Court of India 2018-08-10 disposed

State of Haryana and Ors. etc vs Bant Lal etc

Bench: 2 — Kurian

In Brief

The State of Haryana acquired land for water works and a sewage treatment plant but used only part of it. Both the State and landowners disputed the compensation fixed by the High Court. The Supreme Court offered the claimants two options: accept fixed rates (Rs. 30-40 lakhs per acre depending on use), or have the Government return the unused land and remit the case to the High Court to recalculate compensation for only the land actually used, with both sides free to present new evidence. The claimants chose the second option, and the Court set aside the High Court's valuation and remitted the matter accordingly."
