The Supreme Court dismissed the State's appeal against the High Court's acquittal of respondent Hussain for theft (Section 380), house-breaking by night (Section 457), and causing death in commission of offence (Section 460) IPC. The High Court had reversed the Trial Court's conviction, finding fatal defects in the prosecution: the fatal blow was attributable to co-accused Rashid (a proclaimed offender), not Hussain; stolen property recovery was conducted from an accessible place without independent witnesses; and evidence was insufficient to prove ownership. The Court held that where the High Court's acquittal is based on sound appreciation of evidence and cogent reasoning, the Supreme Court will not re-examine the evidence on appeal, dismissing the State's challenge."
