State of Himachal Pradesh & Ors vs Naval Kumar alias Rohit Kumar

Bench: 2 — Abhay Manohar Sapre

In Brief

An 8-year-old boy suffered 100% permanent disability (loss of both arms) when electrocuted by a high-tension live wire due to State negligence. The High Court awarded Rs. 1,25,00,000 compensation. On appeal, the Supreme Court reduced this to Rs. 90,00,000 with 6% annual interest. The Court held that while the State was vicariously liable for the negligence, the High Court's award lacked adequate evidentiary support for its lump-sum allocations under various heads. The reduced amount, generating income through interest, was found sufficient to meet the child's lifelong maintenance needs."
