State of Himachal Pradesh & Ors vs Naval Kumar alias Rohit Kumar

Bench: 2 — Abhay Manohar Sapre

In Brief

An 8-year-old child suffered 100% permanent disability (loss of both arms) after being electrocuted by a high-tension wire due to State negligence. The victim's mother sought Rs. 50 lakh compensation; the High Court awarded Rs. 1.25 crore under various heads. The Supreme Court upheld the State's vicarious liability but found the High Court's award excessive and not evidentially supported. The Court reduced compensation to Rs. 90 lakh with 6% per annum interest, concluding this reasonably compensates the victim's loss of earning capacity, documented medical expenses, and lifelong dependency while avoiding speculative quantum assessments."
