State of Madhya Pradesh vs Kalicharan & Ors

Bench: 2 — M.R. Shah

In Brief

In this criminal appeal, the Supreme Court considered whether a fatal head injury inflicted with a Farsa (blunt weapon) during a free fight amounted to murder or culpable homicide. The High Court had altered the conviction from Section 302 (murder) to Section 304 Part II (culpable homicide). The Supreme Court held that a single blow to a vital body part causing death can constitute murder or culpable homicide depending on circumstances. In this case, the Court altered the conviction to Section 304 Part I (culpable homicide not amounting to murder) and sentenced the accused to eight years imprisonment, finding the High Court erred in its judgment.
