In Brief
In a criminal appeal arising from a group fight, the State challenged the High Court's decision to downgrade murder convictions. The Supreme Court held that even a single blow to the vital part of the body (the head) can constitute murder. While the accused used the blunt side of a Farsa and it was a free fight scenario, the fatal injury to the head warranted conviction. The Court altered the conviction from culpable homicide (Section 304 Part II) to causing death by rash act (Section 304 Part I) and increased the sentence to eight years rigorous imprisonment with fine.
