The State of Madhya Pradesh challenged a High Court judgment that granted a retired Principal Chief Conservator of Forest (PCCF) pension benefits based on an upgraded pay scale that came into effect after his 2001 retirement. The Supreme Court held that since the apex scale for the upgraded post of Head of Forest Force was effective from 27 September 2008 and required selection-based appointment, a person who retired in 2001 could not claim such benefits. The Court ruled that the High Court wrongly applied the 'equal pay for equal work' principle and improperly exercised its superintendence powers by overturning the Tribunal's order without jurisdictional error or failure of justice.
