The Supreme Court upheld the High Court's direction granting parity in pay scales to Ordnance Factory Board Headquarters Assistants and Personal Assistants with similarly situated Central Secretariat Service and Armed Forces Headquarters Civil Service employees. The Court held that these employees were historically treated as equals, maintained parity through multiple pay commissions, and the discrimination arose only from an intervening upgradation given to all similar employees except those in Ordnance Factories. While generally restraining judicial intervention in complex pay determinations, the Court found Courts may remedy irrational and discriminatory denial of entitlements supported by Pay Commission recommendations and historical practice.
