The State of Madhya Pradesh appealed against the High Court's acquittal of Rajaram, who was convicted of rape (Section 376) and abetting suicide (Section 306). The trial court had sentenced him to 10 years rigorous imprisonment. The Supreme Court upheld the High Court's acquittal, finding that the prosecution's case rested primarily on uncorroborated testimony of a 12-year-old child witness who admitted being threatened by police, and the deceased's father's statement which made no mention of rape in the contemporaneous police complaint. The Court held that absent glaring infirmities or perversity, it will not interfere with High Court acquittals.
