In Brief

The State of Odisha challenged orders from the Odisha Administrative Tribunal and High Court that had reinstated 137 Hindi teachers to aided M.E. Schools. The teachers had been appointed directly by school management in 1988-89 without following the statutory selection procedure prescribed under the Odisha Education Rules, 1974. The Supreme Court held that such appointments violated mandatory statutory procedures and were void. The Tribunal erred by allowing the teachers' applications while ignoring its own earlier consistent orders on the same issue, violating judicial propriety. The Court quashed the Tribunal and High Court orders, dismissed the teachers' Original Applications, and upheld the termination as legally justified.
