This case concerns the illegal appointment and subsequent termination of 137 Hindi teachers and assistant teachers in Aided Middle English Schools in Odisha. The teachers were appointed in violation of the statutory selection procedures required under Rules 5 and 6 of the 1974 Recruitment Rules. Although briefly reinstated following a High Court order, they were again terminated after the State issued show cause notices. The Supreme Court held that the appointment procedure was mandatory and could not be bypassed. The Tribunal erred in reversing terminations without considering its own prior judgments finding the appointments invalid. The Supreme Court allowed the State's appeals, quashed both the Tribunal and High Court orders, and dismissed the teachers' applications.
