The Supreme Court held the High Court erred by not examining whether possession was actually taken over by the State—a critical fact determining whether proceedings could abate under the Repeal Act. The Court clarified that compensation and possession are distinct; non-payment does not negate possession. The case was remanded for the High Court to decide afresh on the possession question and related maintainability issues.
