The State of Orissa challenged a recruitment process for 300 Junior Assistant posts where the Public Service Commission issued a select list of 671 candidates instead of 300, as required by the 1951 Service Rules. The Court held that Rule 9 mandates the select list equal the number of vacancies notified. Creating an excess list without statutory authority violates the Constitution. The Court disapproved the Administrative Tribunal's order directing appointment of all 671 candidates and remitted the matter to examine whether the 361 actual appointments complied with recruitment rules. Appointments beyond notified vacancies are unconstitutional under Articles 14 and 16."
