The State of Orissa requisitioned recruitment of 100 Junior Assistants but the Public Service Commission recommended 671 candidates instead of the notified 300 vacancies. The State appointed 361 of these candidates. The Administrative Tribunal ordered appointment of all 671, but the Supreme Court reversed this, holding that a selection list must equal the notified vacancies. The Court held that inclusion in a selection list does not confer a right to appointment, and the State cannot be compelled to appoint beyond notified vacancies without legal basis. The matter was remitted to the High Court to examine whether the 361 appointments complied with applicable recruitment rules.
