A retired government officer in Punjab, who held the Additional Director rank and had worked in officiating capacity in two higher posts (Joint Director and Additional Director), sought salary for those periods. The State had imposed a condition that he would not receive additional pay. The High Court ruled he was entitled to the higher salary. The Supreme Court upheld this, holding that when an employee performs duties of a higher post, they are entitled to that post's salary regardless of conditions in the original order. The Court distinguished this from cases where eligibility to hold the post itself is contested, and dismissed the State's appeal."
