The respondent, B.K. Dhir, worked as an officiating Joint Director and Additional Director under the Punjab government while drawing his substantive Deputy Director's salary. Upon his retirement in 1993, he claimed payment at the higher posts' salary rates for the periods he served in them. The High Court allowed his plea based on the principle that an employee performing higher duties is entitled to higher pay. The State challenged this, arguing the appointment orders contained restrictive conditions. The Supreme Court dismissed the appeal, holding that once the High Court has granted relief and the employee has actually worked in the higher capacity, restricting clauses and late eligibility objections cannot defeat the justified claim to officiating pay."
