The State of Tripura amended its civil service rules to add new feeder posts for promotion after constituting a selection committee. Candidates excluded under the old rules challenged this, arguing the selection should proceed under pre-amended rules. The High Court agreed. The Supreme Court reversed, holding that candidates have the right to be considered under rules in force at the date of consideration, not when vacancies arose. Since the petitioners were not excluded (merely facing additional competition) and had no vested right to the old rules, the amended rules validly applied. The appeals were allowed and exemplary costs imposed.
