In Brief
The State of U.P. challenged a High Court order restricting its right to verify disability certificates issued to candidates in a teacher training programme. A complaint alleged that many candidates without actual disabilities had fraudulently obtained certificates to access reserved quota seats. Upon verification by a re-constituted Medical Board, 21% of selected candidates were found not disabled. The Supreme Court held that when large-scale fraud in disability certification is proven, the State is entitled to conduct fresh medical examinations to correct the system. The Court rejected the High Court's direction limiting verification to physical inspection only, finding such verification inadequate for detecting various disabilities and ruling that fraud vitiates all protections.
