State of U.P vs Sunil

Bench: 2 — Pinaki Chandra Ghose

In Brief

The State of U.P. appealed against the High Court's acquittal of the accused-respondent, who had been convicted by the trial court of murder and mischief under IPC Sections 302, 429 and 34. The Supreme Court held that the prosecution had failed to establish a complete chain of circumstantial evidence connecting the accused to the incident. Although recovery of weapons and articles occurred, without independent evidence linking them to the accused, they could not sustain conviction. The Court upheld the High Court's acquittal, establishing that in circumstantial evidence cases, each fact must be proved independently and form an unbroken chain; recovery alone is insufficient for conviction.
