State of Uttar Pradesh and Ors vs Pankaj Kumar

Bench: 2 — A.S. Bopanna

In Brief

The State of Uttar Pradesh recruited police constables through direct recruitment commencing in 2015. The respondent candidate failed to appear for the physical fitness test and document verification, claiming he had not received a formal call letter—though notification was sent via SMS to his provided mobile number. The High Court granted him a belated opportunity. The Supreme Court reversed this, holding that recruitment processes require finality. Since the process had substantially concluded in 2018, and other candidates were already given late opportunities in January 2019, granting further exceptions would undermine the recruitment's validity and timeline. SMS notification to a voluntarily provided number, when received, constitutes adequate notice.
