Subharti Medical College vs Union of India and Ors

Bench: 3 — A.M. Khanwilkar

In Brief

Subharti Medical College sought recognition for increased MBBS intake (100–150 seats). The MCI inspection report noted deficiencies including only 55.27% bed occupancy. While the Hearing Committee found no deficiency regarding clinical material and residents, it explicitly stated bed occupancy 'cannot be validated' and 'requires physical verification.' Despite this inconclusive finding, the Competent Authority debarred the college for two years and authorized encashment of its Rs. 2 crore bank guarantee. The Supreme Court set aside the debarring order and directed a fresh inspection within three months, with an opportunity for the college to cure deficiencies and a final decision thereafter, staying encashment of the guarantee."
