Hamdard Institute of Medical Sciences and Research (HIMSR) & Anr vs Union of India and Ors

Bench: 3 — A.M. Khanwilkar

In Brief

Hamdard Institute of Medical Sciences and Research sought renewal of permission to admit a 5th batch of 100 MBBS students for 2016-17. The Ministry debarred the college for two years based on alleged deficiencies in faculty, residents, and bed occupancy. The Supreme Court found deficiencies in faculty and residents were within permissible limits, but bed occupancy deficiency lacked conclusive verification. The Court held the Ministry's order was mechanical and not reasoned as directed. It quashed the debarment order and directed MCI to conduct fresh inspection, allow the college to remedy deficiencies, and then place a verified report before the Competent Authority for a final reasoned decision within one month. The bank guarantee was not to be encashed.
