Suja George and Ors vs National Insurance Co. Ltd. and Anr

Bench: 2 — Kurian

In Brief

The widow and dependents of a deceased motorist sought enhanced compensation from the insurance company. The original compensation was calculated using a monthly income of Rs. 27,219, but evidence (Annexure P6 and income tax returns) showed the actual income was Rs. 33,037 to Rs. 37,477 monthly. After two rounds of litigation, the Court suggested a lump-sum settlement. The insurance company agreed to pay Rs. 9,00,000 as full and final settlement in addition to existing benefits, which the appellants accepted. The Court disposed of the appeal on this agreed settlement.
