Sukhpal Singh filed a suit for specific performance of an agreement to sell. After a lower court allowed his appeal, the defendants filed a second appeal in the High Court. During proceedings, Singh's power of attorney holder entered into a compromise transferring 65% of Singh's property share to a third party (Rajbans Kaur) without Singh's knowledge or instruction. Singh later cancelled the power of attorney and sought to recall the High Court's order approving the compromise. The Supreme Court held that the High Court failed to examine whether the attorney exceeded his authority and whether the time-barred appeal's delay was properly condoned. The Court set aside the High Court's orders and remanded the case for proper reconsideration of limitation, delay condonation, and compromise validity.
