This case concerns a suit for specific performance of an agreement to sell property. After the original defendant died, her legal heirs were impleaded in the execution proceedings. Years later, the appellant (grandson of the original defendant) sought deletion from the party array, claiming he was wrongly impleaded as a legal heir and asserting independent tenancy rights. The Supreme Court upheld the dismissal of this application, holding that once a party has been impleaded as a legal heir after due inquiry without objection, they cannot later seek deletion. The appropriate remedy was to object at the time of impleadment. The Court held the application barred by res judicata, as the issue had attained finality. The Court also rejected the appellant's tenancy claims as unsupported and ordered possession of the property handed to the decree-holder.
