SUNIL @ SONU ETC vs STATE NCT OF DELHI

Bench: 2 — B.R. Gavai, K.V. Viswanathan

In Brief

Two men were convicted of murder (Section 302 IPC) for inflicting fatal knife injuries on another during a street incident. The Supreme Court found that while the appellants did cause the death, there was insufficient evidence of pre-meditation or intent to kill. Importantly, injuries sustained by the appellants themselves—unexplained by the prosecution—suggested a spontaneous mutual fight rather than a calculated attack. The Court found the prosecution's case had credibility gaps and contradictions. The conviction was reduced to causing death without culpable homicide (Section 304 IPC Part-I), and the appellants were released after serving over 8 years imprisonment.
