SUNITA DEVI & ANR vs THE STATE OF HARYANA

Bench: 2 — Aniruddha Bose, Sudhanshu Dhulia

In Brief

Sunita Devi and another challenged the High Court's refusal of anticipatory bail in a case involving cheating allegations related to land transactions. The appellants had voluntarily joined the investigation. The Supreme Court held that where accused persons have cooperated with the investigating agency, custodial interrogation is not necessary. The Court set aside the High Court's order and granted anticipatory bail, while preserving the State's right to seek bail cancellation if the appellants subsequently refused to cooperate with investigators.
