Sunny Khanna vs State of Chhattisgarh

Bench: 2 — Banumathi

In Brief

Sunny Khanna and Pradeep Singh were convicted of murdering two deceased persons during a nighttime altercation at Holika Dahan (a festival). The Supreme Court upheld the conviction for causing the death of Irfan @ Golu but modified it from Section 302 IPC (murder) to Section 304 Part-I IPC (culpable homicide without premeditation) because the incident arose from a sudden fight without undue advantage. The conviction for injuries to Anil Chandrakar under Section 307 IPC was upheld. The witness, though related to the deceased, was credible and corroborated by medical evidence and weapon recovery. Since the appellants had already served over ten years in prison, their sentences were reduced to time served.
