The Supreme Court upheld the High Court's order to demolish two unauthorised residential towers (Apex and Ceyane) constructed in violation of building regulations and apartment ownership laws. The towers were built at only 9 metres distance from an existing tower when regulations required 16-36.5 metres depending on the applicable code. The developer falsely claimed the towers formed a single building block and failed to obtain consent from existing flat owners whose rights to common areas were reduced. The Court found evidence of collusion between the builder and planning authority. The builder must demolish the towers at its own cost within three months and refund all investors with 12% annual interest from date of investment.
