Surendra Wamanrao Deshmukh vs State of Maharashtra and Anr

Bench: 2 — Kurian

In Brief

Surendra Wamanrao Deshmukh was removed from service on compulsory retirement and sought compassionate pension under Rule 100 of the Maharashtra Civil Services (Pension) Rules, 1982. He argued that similarly situated employees had been granted such relief. The High Court declined to examine his claim. The Supreme Court allowed his appeal and directed the State to consider his fresh representation on merits within three months, with an opportunity for a hearing if requested. The Court made clear that its order would not be constrained by the High Court's earlier judgment.
