Supreme Court of India 2017-03-30 dismissed

Suresh Thakar vs Aditya Parakh and Ors

Bench: 2 — Kurian

In Brief

The Supreme Court dismissed rent-related appeals against findings of fact that were concurrent at both lower court levels, finding admitted willful default in payment of rent by the appellants. Though raised, the constitutional question of whether Chhattisgarh could enact a law permitting direct appeals to the Supreme Court (bypassing the High Court) was left undecided, as unnecessary to resolve given the factual position. The appellants were granted time to vacate until October 2017 on condition of clearing arrears and filing an undertaking before the Court.
