Surinder Singh Deswal and others appealed against a conviction for offence under the Negotiable Instruments Act, 1881 s. 138. They had been granted suspension of sentence by the High Court on condition of depositing 25% of compensation, later modified to 20% within 90 days. The appellants failed to comply with this condition, and the Additional Sessions Judge vacated the suspension. The Supreme Court upheld the vacation, holding that a court which suspends a sentence can vacate that suspension upon non-compliance with the condition. The Court found the Additional Sessions Judge acted within jurisdiction and dismissed the appeal, finding no merit in the appellants' submission.
