Susmita Bhattacharya vs Chancellor, D.D.U. Gorakhpur Univ. & Ors

Bench: 2 — Kurian

In Brief

Susmita Bhattacharya, a university employee, sought quashing of an order denying her promotion under the Career Advancement Scheme at Deen Dayal Upadhyay Gorakhpur University. The High Court dismissed her writ petition citing the alternative remedy available under Section 68 of the U.P. State Universities Act. The Supreme Court held that this alternative remedy was merely recourse to the Chancellor—the very authority whose order was being challenged—and was thus not a meaningful alternative. The Court set aside the High Court's order and remanded the case for disposal on merits.
